H&igrave;nh phạt bổ sung l&agrave; phạt tiền 10-50 triệu đồng.<\/span><\/p>\n\nCăn cứ Điều 322 BLHS, h&agrave;nh viTổ chức đ&aacute;nh bạc<\/em>quy định tại điều n&agrave;y c&oacute; thể bị truy tố tr&aacute;ch nhiệm h&igrave;nh sự với h&igrave;nh phạt tiền 50-300 triệu đồng; hoặc phạt t&ugrave; 1-10 năm; h&igrave;nh phạt bổ sung l&agrave; phạt tiền 20-100 triệu đồng, hoặc tịch thu một phần hoặc to&agrave;n bộ t&agrave;i sản.<\/span><\/p>\n\nNhư vậy, t&ugrave;y v&agrave;o mức độ của h&agrave;nh vi m&agrave; cơ quan chức năng sẽ xử l&yacute; nếu nhận được tố gi&aacute;c hoặc th&ocirc;ng qua hoạt động kiểm tra ph&aacute;t hiện ra h&agrave;nh vi vi phạm. Cụ thể:<\/span><\/p>\n\n- Nếu bạn mới tham gia c&aacute; cược một lần, v&agrave; số tiền chỉ v&agrave;i trăm ngh&igrave;n đồng (dưới 5 triệu), th&igrave; bạn c&oacute; thể bị xử phạt 1-2 triệu đồng. Trường hợp bạn đ&atilde; từng bị xử phạt vi phạm h&agrave;nh ch&iacute;nh về h&agrave;nh vi n&agrave;y, hoặc số tiền c&aacute; cược từ 5 triệu đồng trở l&ecirc;n, bạn c&oacute; thể bị truy tố theo Điều 321.<\/span><\/p>\n\n- Nếu bạn kh&ocirc;ng chỉ tham gia m&agrave; c&ograve;n c&oacute; vai tr&ograve; tổ chức c&aacute;c trận c&aacute; cược online th&igrave; chế t&agrave;i đối với h&agrave;nh vi n&agrave;y sẽ nặng hơn. Cụ thể, h&agrave;nh vi tổ chức c&aacute; cược trong hoạt động thi đấu thể dục thể thao m&agrave; số tiền hoặc hiện vật d&ugrave;ng đ&aacute;nh bạc trị gi&aacute; dưới 5 triệu đồng sẽ bị xử phạt 10-20 triệu đồng. text-decoration-style: initial; text-decoration-color: initial; text-align: justify;\">- Người n&agrave;o cố &yacute; g&acirc;y thương t&iacute;ch hoặc g&acirc;y tổn hại cho sức khỏe của người kh&aacute;c m&agrave; tỷ lệ tổn thương cơ thể từ 11% đến 30% hoặc dưới 11% nhưng thuộc một trong c&aacute;c trường hợp quy định tại Khoản 1 Điều n&agrave;y như: d&ugrave;ng hung kh&iacute; nguy hiểm; d&ugrave;ng h&oacute;a chất nguy hiểm; phạm tội đối với 02 người trở l&ecirc;n;&hellip;th&igrave; bị phạt cải tạo kh&ocirc;ng giam giữ đến 03 năm hoặc phạt t&ugrave; từ 06 th&aacute;ng đến 03 năm.<\/span><\/p>\n\n<p style=\"box-sizing: border-box; o khoản 1 Điều n&agrave;y, th&igrave; bị phạt t&ugrave; từ 02 năm đến 05 năm.<\/span><\/p>\n\n<p style=\"box-sizing: border-box; margin: 0px; padding: 5px 0px; color: rgb(34, 34, 34); font-family: Arial, Helvetica, sans-serif; tỷ lệ tổn thương cơ thể từ 31% đến 60% nhưng thuộc một trong c&aacute;c trường hợp quy định tại c&aacute;c điểm a, b, d, đ, e, g, h, i, k, l, m, n v&agrave; o khoản 1 Điều n&agrave;y, th&igrave; bị phạt t&ugrave; chung th&acirc;n: L&agrave;m chết 02 người trở l&ecirc;n; g&acirc;y thương t&iacute;ch hoặc g&acirc;y tổn hại sức khỏe cho 02 người trở l&ecirc;n m&agrave; tỷ lệ tổn thương cơ thể của mỗi người 61% trở l&ecirc;n; g&acirc;y thương t&iacute;ch v&agrave;o v&ugrave;ng mặt của người kh&aacute;c m&agrave; tỷ lệ tổn thương cơ thể 61% trở l&ecirc;n.<\/span><\/p>\n\n<p style=\"box-sizing: border-box; margin: 0px; padding: 5px 0px; color: rgb(34, 34, 34); font-family: Arial, Helvetica, sans-serif; font-size: 14px; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; letter-spacing: normal; text-decoration-color: initial; text-align: justify;\">- Người chuẩn bị phạm tội n&agrave;y, th&igrave; bị phạt cải tạo kh&ocirc;ng giam giữ đến 02 năm hoặc phạt t&ugrave; từ 03 th&aacute;ng đến 02 năm.<\/span><\/p>\n\n<p style=\"box-sizing: border-box; text-decoration-style: initial; text-decoration-color: initial; text-align: justify;\">Như vậy, theo quy định của ph&aacute;p luật, về cơ bản, th&igrave;&nbsp;h&agrave;nh vi cố &yacute; g&acirc;y thương t&iacute;ch sẽ bị khởi tố h&igrave;nh sự theo khoản 1 Điều 134 n&ecirc;u tr&ecirc;n, nếu mức độ thương t&iacute;ch từ 11% đến 30%<\/strong>.<\/span><\/p>\n\n<p style=\"box-sizing: border-box; text-decoration-style: initial; text-decoration-color: initial; text-align: justify;\">Tuy nhi&ecirc;n, khi thực hiện h&agrave;nh vi g&acirc;y thương t&iacute;ch m&agrave; c&oacute; một trong c&aacute;c c&aacute;c điều kiện được quy định từ điểm a đến điểm k khoản 1 Điều 134 Bộ luật H&igrave;nh sự 2015 th&igrave; text-decoration-style: initial; text-decoration-color: initial; text-align: justify;\">Khi x&aacute;c định được đầy đủ c&aacute;c dấu hiệu của tội phạm th&igrave; cơ quan c&oacute; thẩm quyền sẽ truy cứu tr&aacute;ch nhiệm h&igrave;nh sự. Việc &aacute;p dụng h&igrave;nh phạt sẽ do cơ quan tố tụng xem x&eacute;t, quyết định. B&ecirc;n cạnh việc c&oacute; thể phải chịu h&igrave;nh phạt theo quy định của ph&aacute;p luật th&igrave; người n&agrave;o bị truy tố c&ograve;n c&oacute; tr&aacute;ch nhiệm bồi thường thiệt hại cho người bị hại tức l&agrave; người phụ nữa bị đ&aacute;nh kia do sức khỏe bị x&acirc;m phạm. Thiệt hại do sức khỏe bị x&acirc;m phạm được bồi thường được quy định tại Điều 590&nbsp;<a href=\"https:\/\/luatvietnam.vn\/dan-su\/bo-luat-dan-su-2015-101333-d1.html\" style=\"box-sizing: border-box; color: rgb(166, 121, 66) !important; text-decoration: underline !important;\" target=\"_blank\">Bộ luật D&acirc;n sự 2015<\/a>. Bao gồm:<\/span><\/p>\n\n<p style=\"box-sizing: border-box; margin: 0px; padding: 5px 0px; color: rgb(34, 34, 34); font-family: Arial, Helvetica, sans-serif; font-size: 14px; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; letter-spacing: normal; text-indent: 0px; text-transform: none; white-space: normal; word-spacing: 0px; -webkit-text-stroke-width: 0px; background-color: rgb(244, 244, 244); text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial; text-align: justify;\">- Chi ph&iacute; hợp l&yacute; cho việc cứu chữa, bồi dưỡng, phục hồi sức khỏe v&agrave; chức năng bị mất, bị giảm s&uacute;t của người bị thiệt hại bao gồm: tiền thu&ecirc; phương tiện đưa người bị thiệt hại đi cấp cứu tại cơ sở y tế; tiền thuốc v&agrave; tiền mua c&aacute;c thiết bị y tế, chi ph&iacute; chiếu, chụp X quang, chụp cắt lớp, si&ecirc;u &acirc;m, x&eacute;t nghiệm, mổ, truyền m&aacute;u, vật l&yacute; trị liệu... theo chỉ định của b&aacute;c sĩ; tiền viện ph&iacute;; tiền mua thuốc bổ, tiếp đạm, tiền bồi dưỡng phục hồi sức khỏe cho người bị thiệt hại theo chỉ định của b&aacute;c sĩ; c&aacute;c chi ph&iacute; thực tế, cần thiết kh&aacute;c cho người bị thiệt hại (nếu c&oacute;) v&agrave; c&aacute;c chi ph&iacute; cho việc khắc phục thẩm mỹ... để hỗ trợ hoặc thay thế một phần chức năng của cơ thể bị mất hoặc bị giảm s&uacute;t của người bị thiệt hại (nếu c&oacute;).<\/span><\/p>\n\n<p style=\"box-sizing: border-box; margin: 0px; padding: 5px 0px; color: rgb(34, 34, 34); font-family: Arial, Helvetica, sans-serif; font-size: 14px; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; letter-spacing: normal; text-indent: 0px; text-transform: none; white-space: normal; word-spacing: 0px; -webkit-text-stroke-width: 0px; background-color: rgb(244, 244, 244); text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial; text-align: justify;\">- Thu nhập thực tế bị mất hoặc bị giảm s&uacute;t của người bị thiệt hại. Nếu trước khi sức khỏe bị x&acirc;m phạm người bị thiệt hại c&oacute; thu nhập thực tế, nhưng do sức khỏe bị x&acirc;m phạm họ phải đi điều trị v&agrave; do đ&oacute; khoản thu nhập thực tế của họ bị mất hoặc bị giảm s&uacute;t, th&igrave; họ được bồi thường khoản thu nhập thực tế bị mất hoặc bị giảm s&uacute;t đ&oacute;.<\/span><\/p>\n\n<p style=\"box-sizing: border-box; margin: 0px; padding: 5px 0px; color: rgb(34, 34, 34); font-family: Arial, Helvetica, sans-serif; hợp l&yacute; v&agrave; phần thu nhập thực tế bị mất của người chăm s&oacute;c người bị thiệt hại trong thời gian điều trị.<\/span><\/p>\n\n<p style=\"box-sizing: border-box; margin: 0px; padding: 5px 0px; color: rgb(34, 34, 34); font-family: Arial, Helvetica, sans-serif; font-size: 14px; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; letter-spacing: normal; text-decoration-color: initial; text-align: justify;\">- Trong trường hợp sau khi điều trị, người bị thiệt hại mất khả năng lao động v&agrave; cần c&oacute; người thường xuy&ecirc;n chăm s&oacute;c (người bị thiệt hại kh&ocirc;ng c&ograve;n khả năng lao động do bị liệt cột sống, m&ugrave; hai mắt, liệt hai chi, bị t&acirc;m thần nặng v&agrave; c&aacute;c trường hợp kh&aacute;c do cơ quan nh&agrave; nước c&oacute; thẩm quyền quy định bị suy giảm khả năng lao động vĩnh viễn từ 81% trở l&ecirc;n) th&igrave; đắp tổn thất về tinh thần do sức khỏe bị x&acirc;m phạm.<\/span><\/p>\n\n<p style=\"box-sizing: border-box; margin: 0px; padding: 5px 0px; color: rgb(34, 34, 34); font-family: Arial, Helvetica, sans-serif; cần vợ, chồng cũ đồng &yacute; kh&ocirc;ng?<\/strong><\/em><\/span><\/p>\n\nTrường hợp t&aacute;ch hộ sau ly h&ocirc;n quy định tại Điểm b Khoản 1 Điều 27 Luật Cư tr&uacute; 2020 th&igrave; hồ sơ t&aacute;ch hộ bao gồm tờ khai thay đổi th&ocirc;ng tin cư tr&uacute;, giấy tờ, t&agrave;i liệu chứng minh việc ly h&ocirc;n v&agrave; việc tiếp tục được sử dụng chỗ ở hợp ph&aacute;p đ&oacute;.<\/span><\/span><\/b><\/span><\/span><\/span><\/p>\n\nLuật Cư tr&uacute; 2020 bắt đầu c&oacute; hiệu lực từ ng&agrave;y 1-7-2021, với nhi&ecirc;̀u đi&ecirc;̉m mới quan trọng, trong đ&oacute; có quy định mới về việc t&aacute;ch hộ khẩu sau ly h&ocirc;n.<\/span><\/span><\/span><\/span><\/span><\/p>\n\nCụ thể, tại Khoản 1 Điều 25 Luật Cư tr&uacute; 2020 quy định th&agrave;nh vi&ecirc;n hộ gia đ&igrave;nh được t&aacute;ch hộ để đăng k&yacute; thường tr&uacute; tại c&ugrave;ng một chỗ ở hợp ph&aacute;p khi c&oacute; năng lực h&agrave;nh vi d&acirc;n sự đầy đủ; trường hợp c&oacute; nhiều th&agrave;nh vi&ecirc;n c&ugrave;ng đăng k&yacute; t&aacute;ch hộ để lập th&agrave;nh một hộ gia đ&igrave;nh mới th&igrave; trong số c&aacute;c th&agrave;nh vi&ecirc;n đ&oacute; c&oacute; &iacute;t nhất một người c&oacute; năng lực h&agrave;nh vi d&acirc;n sự đầy đủ.<\/span><\/span><\/span><\/span><\/span><\/p>\n\nĐ&ocirc;̀ng thời, được chủ hộ, chủ sở hữu chỗ ở hợp ph&aacute;p đồng &yacute;, trừ trường hợp th&agrave;nh vi&ecirc;n hộ gia đ&igrave;nh đăng k&yacute; t&aacute;ch hộ l&agrave; vợ, chồng đ&atilde; ly h&ocirc;n m&agrave; vẫn được c&ugrave;ng sử dụng chỗ ở hợp ph&aacute;p đ&oacute;; Nơi thường tr&uacute; của hộ gia đ&igrave;nh kh&ocirc;ng thuộc c&aacute;c địa điểm bị cấm đăng k&yacute; thường tr&uacute; mới theo quy định tại Điều 23 Luật Cư tr&uacute; 2020.<\/span><\/span><\/span><\/span><\/span><\/p>\n\nTrong khi đó, theo quy định của Lu&acirc;̣t Cư trú hi&ecirc;̣n hành thì người đ&atilde; nhập v&agrave;o sổ hộ khẩu quy định tại Khoản 3 Điều 25 v&agrave; Khoản 2 Điều 26 Luật Cư tr&uacute; 2007 m&agrave; muốn t&aacute;ch hộ khẩu phải được chủ hộ đồng &yacute; cho t&aacute;ch sổ hộ khẩu bằng văn bản.<\/span><\/span><\/span><\/span><\/span><\/p>\n\nĐi&ecirc;̀u này đã d&acirc;̃n đ&ecirc;́n trong thực t&ecirc;́ sau khi ly h&ocirc;n, kh&ocirc;ng ít gia đình nhà ch&ocirc;̀ng hoặc người ch&ocirc;̀ng đã lợi dụng qui định này, kh&ocirc;ng ký đ&ocirc;̀ng ý cho tách h&ocirc;̣ đ&ecirc;̉ c&ocirc;́ tình g&acirc;y khó d&ecirc;̃ cho người vợ. Vi&ecirc;̣c kh&ocirc;ng tách được h&ocirc;̣ kh&acirc;̉u đã g&acirc;y h&ecirc;̣ lụy cho kh&ocirc;ng ít người vợ khi thực hi&ecirc;̣n các giao dịch, thủ tục hành chính c&acirc;̀n sử dụng đ&ecirc;́n s&ocirc;̉ h&ocirc;̣ kh&acirc;̉u.<\/span><\/span><\/span><\/span><\/span><\/p>\n\nMặc dù, trong Th&ocirc;ng tư 35\/2014\/TT-BCA của B&ocirc;̣ C&ocirc;ng an đã qui định người đứng t&ecirc;n chủ hộ c&oacute; tr&aacute;ch nhiệm tạo điều kiện thuận lợi cho những người c&ugrave;ng c&oacute; t&ecirc;n trong sổ hộ khẩu được sử dụng sổ để giải quyết c&aacute;c c&ocirc;ng việc theo quy định của ph&aacute;p luật. Trường hợp cố t&igrave;nh g&acirc;y kh&oacute; khăn, th&igrave; t&ugrave;y theo t&iacute;nh chất, mức độ vi phạm m&agrave; bị xử l&yacute; theo quy định của ph&aacute;p luật. Tuy nhi&ecirc;n, trong thực t&ecirc;́, vi&ecirc;̣c này v&acirc;̃n xảy ra, và cũng r&acirc;́t ít trường hợp bị xử lý.<\/span><\/span><\/span><\/span><\/span><\/p>\n\nKhắc phục b&acirc;́t c&acirc;̣p này, Lu&acirc;̣t Cư trú 2020 đã qui định điều kiện để được t&aacute;ch hộ khẩu trong trường hợp sau ly h&ocirc;n thu&acirc;̣n lợi hơn, kh&ocirc;ng c&acirc;̀n người vợ hoặc ch&ocirc;̀ng cũ là chủ h&ocirc;̣ kh&acirc;̉u đ&ocirc;̀ng ý, thì người vợ hoặc ch&ocirc;̀ng v&acirc;̃n có th&ecirc;̉ tách h&ocirc;̣ kh&acirc;̉u ri&ecirc;ng.<\/span><\/span><\/span><\/span><\/span><\/p>\n\nCụ thể, từ ng&agrave;y 1-7-2021, hồ sơ t&aacute;ch hộ bao gồm tờ khai thay đổi th&ocirc;ng tin cư tr&uacute;, trong đ&oacute; ghi r&otilde; &yacute; kiến đồng &yacute; cho t&aacute;ch hộ của chủ hộ, chủ sở hữu chỗ ở hợp ph&aacute;p, trừ trường hợp đ&atilde; c&oacute; &yacute; kiến đồng &yacute; bằng văn bản. Ri&ecirc;ng trường hợp t&aacute;ch hộ sau ly h&ocirc;n quy định tại Điểm b Khoản 1 Điều 27 Luật Cư tr&uacute; 2020 th&igrave; hồ sơ t&aacute;ch hộ bao gồm tờ khai thay đổi th&ocirc;ng tin cư tr&uacute;, giấy tờ, t&agrave;i liệu chứng minh việc ly h&ocirc;n v&agrave; việc tiếp tục được sử dụng chỗ ở hợp ph&aacute;p đ&oacute;.<\/span><\/span><\/span><\/span><\/span><\/p>\n\nSau khi nộp hồ sơ t&aacute;ch hộ theo quy định đến cơ quan đăng k&yacute; cư tr&uacute;, trong thời hạn 5 ng&agrave;y l&agrave;m việc kể từ ng&agrave;y nhận được hồ sơ đầy đủ v&agrave; hợp lệ, cơ quan đăng k&yacute; cư tr&uacute; c&oacute; tr&aacute;ch nhiệm thẩm định, cập nhật th&ocirc;ng tin về hộ gia đ&igrave;nh li&ecirc;n quan đến việc t&aacute;ch hộ v&agrave;o Cơ sở dữ liệu về cư tr&uacute; v&agrave; th&ocirc;ng b&aacute;o cho người đăng k&yacute; về việc đ&atilde; cập nhật th&ocirc;ng tin; trường hợp từ chối giải quyết t&aacute;ch hộ th&igrave; phải trả lời bằng văn bản v&agrave; n&ecirc;u r&otilde; l&yacute; do.<\/span><\/span><\/span><\/span><\/span><\/p>\n\n&nbsp;<\/p>\n\nSau khi cha mẹ ly h&ocirc;n, con dưới 36 th&aacute;ng tuổi đương nhi&ecirc;n được giao cho mẹ trực tiếp nu&ocirc;i?<\/strong><\/span><\/p>\n\nCăn cứ v&agrave;o khoản 3 Điều 81 quy định về việc tr&ocirc;ng nom, chăm s&oacute;c, nu&ocirc;i dưỡng, gi&aacute;o dục con sau khi ly h&ocirc;n th&igrave; con dưới 36 th&aacute;ng tuổi được giao cho mẹ trực tiếp nu&ocirc;i, trừ trường hợp người mẹ kh&ocirc;ng đủ điều kiện để trực tiếp tr&ocirc;ng nom, chăm s&oacute;c, nu&ocirc;i dưỡng, gi&aacute;o dục con; hoặc cha mẹ c&oacute; thỏa thuận kh&aacute;c ph&ugrave; hợp với lợi &iacute;ch của con.<\/span><\/p>\n\nNhư vậy, trường hợp cha mẹ c&oacute; thỏa thuận về việc tr&ocirc;ng nom, chăm s&oacute;c, nu&ocirc;i dưỡng con th&igrave; t&ograve;a &aacute;n sẽ ghi nhận sự thỏa thuận n&agrave;y. Ngo&agrave;i ra, nếu con dưới 36 th&aacute;ng tuổi nhưng người mẹ kh&ocirc;ng đủ điều kiện để trực tiếp nu&ocirc;i con (điều kiện kinh tế, điều kiện sống, điều kiện nh&acirc;n th&acirc;n...) th&igrave; người cha c&oacute; thể chứng minh để t&ograve;a &aacute;n xem x&eacute;t v&agrave; quyết địnhb&ecirc;n trực tiếp nu&ocirc;i con căn cứ v&agrave;o quyền lợi về mọi mặt của con.<\/span><\/p>\n\n&nbsp;<\/p>\n\nHỏi: Sau khi ly h&ocirc;n, người kh&ocirc;ng trực tiếp nu&ocirc;i con c&oacute; quyền, nghĩa vụ thăm nom con?<\/strong><\/span><\/p>\n\nKhoản 3 Điều 82 Luật HN&amp;GĐ quy định: &quot;Sau khi ly h&ocirc;n, người kh&ocirc;ng trực tiếp nu&ocirc;i con c&oacute; quyền, nghĩa vụ thăm nom con m&agrave; kh&ocirc;ng ai được cản trở. Cha, mẹ kh&ocirc;ng trực tiếp nu&ocirc;i con lạm dụng việc thăm nom để cản trở hoặc g&acirc;y ảnh hưởng xấu đến việc tr&ocirc;ng nom, chăm s&oacute;c, nu&ocirc;i dưỡng, gi&aacute;o dục con th&igrave; người trực tiếp nu&ocirc;i con c&oacute; quyền y&ecirc;u cầu t&ograve;a &aacute;n hạn chế quyền thăm nom con của người đ&oacute;.&quot;<\/span><\/p>\n\nNhư vậy, sau khi ly h&ocirc;n cha\/mẹ kh&ocirc;ng trực tiếp nu&ocirc;i con kh&ocirc;ng bị hạn chế về số lần, thời gian v&agrave; kh&ocirc;ng ai được cản trở. Nhưng đồng thời cha\/mẹ kh&ocirc;ng trực tiếp nu&ocirc;i con kh&ocirc;ng được lạm dụng việc thăm nom để cản trở hoặc g&acirc;y ảnh hưởng xấu đến việc tr&ocirc;ng nom, chăm s&oacute;c, nu&ocirc;i dưỡng, gi&aacute;o dục con. quyền tự do lựa chọn việc l&agrave;m, nơi l&agrave;m việc, nghề nghiệp v&agrave; c&oacute; thể l&agrave;m việc cho bất kỳ người sử dụng lao động n&agrave;o v&agrave; ở bất kỳ đ&acirc;u, miễn kh&ocirc;ng tr&aacute;i ph&aacute;p luật.<\/span><\/p>\n\nHiện ph&aacute;p luật kh&ocirc;ng cấm người lao động l&agrave;m th&ecirc;m c&ocirc;ng việc kh&aacute;c ngo&agrave;i c&ocirc;ng việc ch&iacute;nh. V&igrave; vậy, người lao động c&oacute; quyền l&agrave;m đồng thời nhiều c&ocirc;ng việc tại c&ugrave;ng một thời điểm, chỉ cần đảm bảo việc kh&ocirc;ng ảnh hưởng đến c&ocirc;ng việc ch&iacute;nh.<\/span><\/p>\n\nPh&aacute;p luật cho ph&eacute;p người lao động l&agrave;m đồng thời nhiều c&ocirc;ng việc một l&uacute;c, tuy nhi&ecirc;n việc bạn c&oacute; hay kh&ocirc;ng được l&agrave;m việc ngo&agrave;i giờ lại phụ thuộc v&agrave;o hợp đồng lao động đ&atilde; k&yacute; kết với c&ocirc;ng ty.<\/span><\/p>\n\nC&ocirc;ng ty c&oacute; quyền cấm người lao động đi l&agrave;m th&ecirc;m khi hai b&ecirc;n đ&atilde; thống nhất thỏa thuận với nhau trong hợp đồng lao động điều khoản: &quot;Người lao động kh&ocirc;ng được ph&eacute;p l&agrave;m th&ecirc;m c&ocirc;ng việc c&oacute; thể ảnh hưởng đến hiệu quả của c&ocirc;ng việc ch&iacute;nh&quot;. Như vậy, bạn phải dựa v&agrave;o điều khoản trong hợp đồng lao động để biết m&igrave;nh c&oacute; quyền l&agrave;m th&ecirc;m ngo&agrave;i giờ hay kh&ocirc;ng.<\/span><\/p>\n\nĐiều 36 Bộ luật Lao động 2019 quy định, c&ocirc;ng ty chỉ c&oacute; quyền đơn phương chấm dứt hợp đồng đối với người lao động khi:<\/span><\/p>\n\n- Người lao động thường xuy&ecirc;n kh&ocirc;ng ho&agrave;n th&agrave;nh c&ocirc;ng việc theo hợp đồng lao động;<\/span><\/p>\n\n- Người lao động kh&ocirc;ng đủ sức khỏe để thực hiện c&ocirc;ng việc;<\/span><\/p>\n\n- Do thi&ecirc;n tai, dịch bệnh, hỏa hoạn hoặc y&ecirc;u cầu của cơ quan nh&agrave; nước c&oacute; thẩm quyền buộc cắt giảm nh&acirc;n sự;<\/span><\/p>\n\n- Người lao động đủ tuổi nghỉ hưu;<\/span><\/p>\n\n- Người lao động tự &yacute; bỏ việc 5 ng&agrave;y li&ecirc;n tục trở l&ecirc;n;<\/span><\/p>\n\n- Người lao động cung cấp th&ocirc;ng tin kh&ocirc;ng trung thực khi giao kết hợp đồng lao động.<\/span><\/p>\n\nNếu sa thải người lao động v&igrave; l&yacute; do kh&ocirc;ng ch&iacute;nh đ&aacute;ng, c&ocirc;ng ty phải nhận người lao động trở lại l&agrave;m việc theo hợp đồng đ&atilde; giao kết, phải trả tiền lương, đ&oacute;ng bảo hiểm x&atilde; hội, bảo hiểm y tế, bảo hiểm thất nghiệp trong những ng&agrave;y người lao động kh&ocirc;ng được l&agrave;m việc v&agrave; phải trả th&ecirc;m cho người lao động một khoản tiền &iacute;t nhất bằng 2 th&aacute;ng lương theo hợp đồng lao động.<\/span><\/p>\n\nTrước khi đơn phương chấm dứt hợp đồng, c&ocirc;ng ty phải b&aacute;o trước cho người lao động &iacute;t nhất 45 ng&agrave;y đối với hợp đồng lao động kh&ocirc;ng x&aacute;c định thời hạn, 30 ng&agrave;y đối với hợp đồng c&oacute; thời hạn từ 12 th&aacute;ng đến 36 th&aacute;ng v&agrave; 3 ng&agrave;y đối với hợp đồng c&oacute; thời hạn dưới 12 th&aacute;ng.
